Watch: Emilie Kiser’s Husband Brady Kiser Won’t Be Charged Over Son Trigg’s Death
Certain details about the death of Emilie Kiser‘s son Trigg Kiser will not be released to the public.
Two weeks after prosecutors opted not to charge the influencer’s husband Brady Kiser with child abuse in the May drowning of their 3-year-old, the Arizona Superior Court for Maricopa County ruled in favor of Emilie to redact two pages from a Chandler Police Department report on the fatal incident.
“The transcript on the disputed sections are not necessary for public accountability,” Judge Christopher Whitten wrote in an Aug. 8 brief viewed by E! News. “Its disclosure would serve no purpose other than satisfying morbid curiosity.”
In response, Emilie’s lawyer Shannon Clark said the 26-year-old is “grateful to Judge Whitten for carefully balancing the important interests at stake and allowing a narrow but meaningful redaction to the Chandler police report, removing two pages that detail the graphic final moments of Trigg’s life.”
“These redactions do not alter any material facts of the accident,” the attorney told E! News in an Aug. 8 statement, “but they protect the dignity of a little boy whose memory should reflect the love and light he brought to the world.”
Emilie’s legal team submitted a request to remove the pages in late July, arguing that details within them could be used to create “disturbing” content about Trigg—who passed away from his injuries six days after the incident—through reenactments with artificial intelligence, per court documents obtained by People.
However, Michael Kelley, an attorney representing The Arizona Republic newspaper, contended in court filings that Emilie’s request would also redact “information and context that is critical to provide the public a reasonably full understanding of the investigation of the drowning, the police department’s decision to recommend criminal charges and the county attorney’s decision not to pursue criminal charges.”
Trigg was at home with his dad Brady and his newborn brother Theodore on May 12 when he drowned in the family’s backyard pool. First responders rushed the toddler to the hospital, where he succumbed to his injuries six days later on May 18.
And while Chandler police submitted a report recommending a Class 4 felony charge of child abuse against Brady over Trigg’s death, Maricopa County attorney Rachel Mitchell said that her office will not pursue the charge “because there is no reasonable likelihood of conviction.”
“Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events,” a July 25 statement from the Maricopa County Attorney’s Office read, saying that prosecutors chose not to move forward with the case after a “careful review of the evidence.”
